Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and MogLock ("MogLock," "we," "us," or "our") governing your use of the MogLock iOS app, any website or page that links to these Terms, and related services, features, content, support, sync, and subscription functionality (collectively, the "Service").

By creating an account, downloading the app, starting a trial or subscription, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Your use of the Service is also subject to our Privacy Policy.

1. Eligibility

You may use the Service only if:

  • you are at least 13 years old, or the minimum age of digital consent where you live;
  • you have legal capacity to agree to these Terms; and
  • your use of the Service is not prohibited by applicable law.

If you are under the age of majority where you live, you may use the Service only with the involvement and consent of a parent or legal guardian where required by law.

2. Important Service Disclosures

MogLock is a habit, posture, and wellness support tool. It is not medical advice, medical care, diagnosis, treatment, physical therapy, or an emergency service.

You understand and agree that:

  • MogLock does not guarantee any physical, cosmetic, fitness, or health outcome;
  • routine instructions, streaks, verification signals, scores, and progress features are informational and motivational only;
  • you are responsible for deciding whether any routine, exercise, posture practice, or self-improvement activity is appropriate for you;
  • you should stop any activity that causes pain, discomfort, dizziness, or other adverse effects; and
  • you should consult a qualified medical or health professional before beginning or changing any exercise, posture, wellness, or body-care routine, especially if you have an injury, condition, or concern.

Do not rely on the Service for emergency needs, urgent medical decisions, or any safety-critical function.

3. Accounts and Sign-In

To use core features of MogLock, you may need to create or access a MogLock account using Sign in with Apple, Google Sign-In, or any other sign-in method we make available.

You agree to:

  • provide accurate and current account information;
  • maintain the security of your device and sign-in methods;
  • use only accounts and credentials you are authorized to use;
  • notify us promptly if you believe your account has been compromised; and
  • remain responsible for activity that occurs through your account unless caused by our misconduct.

We may suspend, restrict, or terminate access if we reasonably believe your account is being used in violation of these Terms, applicable law, or platform rules.

4. Subscriptions, Free Trials, Billing, and Read-Only Access

MogLock currently offers a monthly auto-renewing subscription through Apple's App Store. Some users may be eligible for a free trial or other introductory offer.

By starting a trial or subscription, you understand and agree that:

  • subscription pricing, billing cadence, taxes, eligibility, and renewal terms are presented through Apple's purchase flow and may vary by region or storefront;
  • your Apple account will be charged at confirmation of purchase, or after any disclosed free-trial period ends, unless you cancel in time under Apple's rules;
  • subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period;
  • your Apple account may be charged for renewal within 24 hours before the end of the current billing period;
  • trial eligibility is determined by Apple and may not be available to every user;
  • you can manage or cancel your subscription through your Apple App Store account settings;
  • refunds, if any, are handled by Apple under Apple's policies unless applicable law requires otherwise; and
  • we may use RevenueCat or similar subscription infrastructure to manage entitlement status, restore purchases, and subscription state.

If your premium entitlement becomes inactive, MogLock may move your account into a limited or read-only state while preserving your prior history. Premium-only features may become unavailable immediately when entitlement ends.

Deleting your MogLock account does not automatically cancel your App Store subscription. Subscription cancellation must be handled separately through Apple.

5. Commitment Lock and Screen Time Features

MogLock may offer an optional commitment-lock feature that uses Apple's Screen Time frameworks to help you restrict access to selected apps, categories, or web domains based on settings you choose.

By using this feature, you understand and agree that:

  • the feature is voluntary and depends on permissions, settings, and targets you select;
  • the feature applies only to selected targets, not your entire device;
  • Apple platform behavior, permissions, device state, and system limitations may affect enforcement, timing, and availability;
  • emergency functions, Apple-controlled escape hatches, and other platform exceptions may remain available;
  • we cannot guarantee uninterrupted enforcement, absolute reliability, or compatibility across every device state or iOS release;
  • public Screen Time APIs do not allow MogLock to deep-link directly from the shield into the parent app; and
  • the feature may be disabled, cleared, interrupted, or become unavailable if permissions are revoked, device conditions change, or premium entitlement ends.

You must not rely on the commitment-lock feature as a parental-control tool, safety control, law-enforcement tool, or guaranteed device-restriction mechanism.

6. License and Permitted Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the MogLock app for your personal, non-commercial use on Apple-branded devices that you own or control, in accordance with these Terms and the App Store usage rules.

You may not:

  • copy, sell, resell, rent, lease, sublicense, distribute, or commercially exploit the Service;
  • reverse engineer, decompile, disassemble, or attempt to derive source code except where prohibited by law;
  • interfere with, disrupt, disable, overburden, or bypass the Service or its security-related features;
  • access another person's account or data without permission;
  • use the Service in violation of law, regulation, export controls, sanctions, or third-party rights;
  • use the Service to harass, abuse, impersonate, defraud, or harm others;
  • upload or submit content you do not have the right to use; or
  • use the Service in a way that could create legal liability for MogLock, its users, or its service providers.

7. User Content

You may provide or create content in the Service, including profile information, progress photos, optional logs, support submissions, and other materials ("User Content").

You retain ownership of your User Content. However, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify as technically necessary, sync, process, and display your User Content solely as needed to operate, maintain, secure, improve, and provide the Service to you.

You represent and warrant that:

  • you own or control the rights needed to submit and use your User Content in connection with the Service;
  • your User Content does not violate law, regulation, or third-party rights; and
  • your User Content does not include unlawful, infringing, harmful, or abusive material.

We may remove or disable access to User Content if we reasonably believe it violates these Terms, applicable law, platform rules, or third-party rights.

8. Intellectual Property and Feedback

The Service, including the app, software, design, text, graphics, trademarks, logos, and other content provided by MogLock, is owned by or licensed to us and is protected by intellectual-property and other laws.

Except for the limited license granted in these Terms, no rights are granted to you.

If you provide ideas, suggestions, or feedback about the Service, you grant us the right to use that feedback without restriction or compensation to you.

9. Third-Party Services and App Store Terms

The Service may rely on third-party services, including Apple, Google, Supabase, and RevenueCat. Your use of those services may be subject to their separate terms, policies, and practices.

If you downloaded the app from Apple's App Store:

  • these Terms are between you and MogLock, not Apple;
  • Apple is not responsible for the Service or its content;
  • Apple has no obligation to furnish maintenance or support services for the Service;
  • to the maximum extent permitted by law, Apple has no warranty obligation with respect to the Service;
  • if the Service fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price for the app to the extent required by applicable law, but Apple will have no other warranty obligation;
  • Apple is not responsible for claims relating to the Service, including product-liability claims, legal or regulatory compliance claims, or consumer-protection claims, except as required by law;
  • Apple is not responsible for investigating, defending, settling, or discharging any third-party intellectual-property claim relating to the Service; and
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as they relate to the Service.

10. Changes to the Service

We may modify, suspend, or discontinue all or part of the Service at any time, including features, content, or availability, with or without notice, as permitted by law.

We are not liable for changes, suspensions, or discontinuation of the Service to the maximum extent permitted by law.

11. Suspension, Termination, Sign-Out, and Account Deletion

You may stop using the Service at any time. We may suspend or terminate your access, with or without notice, if we reasonably believe:

  • you breached these Terms;
  • your use creates security, legal, reputational, or operational risk; or
  • we are required to do so by law, platform rules, or a valid legal order.

If your account is suspended, terminated, signed out, or deleted:

  • your right to use the Service may stop immediately or become limited;
  • local data on your device may be cleared when you sign out or delete the account;
  • some information may remain in backups, logs, or records as permitted by law and our Privacy Policy;
  • premium access may end or become unavailable; and
  • deleting your MogLock account does not automatically cancel your App Store subscription.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOGLOCK DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, AND THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR ACHIEVE ANY PARTICULAR RESULT.

Without limiting the foregoing, we do not warrant that:

  • the Service will meet your requirements or expectations;
  • routines, posture guidance, verification outputs, or progress information will be accurate, complete, or suitable for any particular person;
  • progress photos, sync, or Screen Time-related features will always be available or preserved without interruption; or
  • any device restriction or commitment-lock outcome will occur exactly as expected in every device state.

Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOGLOCK AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

  • THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
  • USD $100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

14. Indemnity

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless MogLock and its affiliates, officers, employees, contractors, licensors, and service providers from and against claims, liabilities, damages, judgments, losses, and expenses arising out of or related to:

  • your use of the Service;
  • your User Content;
  • your violation of these Terms; or
  • your violation of applicable law or third-party rights.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Hawaii, without regard to conflict-of-law rules.

You and MogLock agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Honolulu, Hawaii, unless applicable law requires otherwise.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms, update the "Last updated" date, and take any additional steps required by law.

Your continued use of the Service after updated Terms become effective means you accept the revised Terms.

17. Miscellaneous

These Terms, together with any policies or additional terms expressly incorporated by reference, form the entire agreement between you and MogLock regarding the Service.

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any provision of these Terms is not a waiver of that provision.

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, asset sale, or by operation of law.

Sections that by their nature should survive termination will survive, including provisions relating to ownership, feedback, disclaimers, limitations of liability, indemnity, governing law, and disputes.
